2 face charges in Berks man’s overdose death

Feb. 24 – Berks County authorities on Tuesday brought new charges against the death of a Boyertown man who overdosed on heroin in December, the Berks County Detectives Office said.

Boyertown, 20 year old Jesus Cruz was charged with heroin / fentanyl trafficking, which resulted in death.

Cruz, who is in Berks County Jail, was charged with possessing and selling heroin in December. He had an unlicensed firearm and the criminal use of a communication device in connection with the incident.

After being detained at the Berks County’s Central Processing Center, Cruz was indicted Tuesday in District Judge Michael G. Hartman. The amount of his bail was not available.

Keyaira Nunez-Trego, 28, described as Cruz’s friend in court documents, has been charged with possession of illegal drugs for the purpose of delivery and of criminal conspiracy. She is expected to report to the authorities on Wednesday.

The most recent charges arose from a final autopsy report and death certificate issued on Jan. 21, which attributed the victim’s death to acute fentanyl toxicity.

According to the police:

Eastern Berks Regional Police were dispatched to a report from an unresponsive man at 1200 Montgomery Avenue in Boyertown at around 2:40 p.m. on December 5. While at the deceased victim’s house, officers found 12 packets of heroin / fentanyl and the victim’s cell phone.

An initial investigation by Eastern Berks officials and Berks County detectives identified Cruz, who lived on Reading Avenue’s 200 block, as a suspect.

On December 6, officials watched Cruz and Nunez-Trego leave their homes in a silver vehicle. In the event of a subsequent traffic obstruction, the officers found a black 9-mm pistol from Keltec and five packets suspected of heroin / fentanyl in the vehicle.

The officers received a search warrant from Hartman and found 130 rounds of 22mm and 9mm ammunition, a second Keltec pistol, drug paraphernalia and an unspecified amount of money in Cruz’s apartment.

Cruz was charged on a variety of drug abuse charges and was jailed in Berks County Jail on bail.
